2. Conditions of Use of the Malimali Website

Malimali Store repudiates any type of information, products, services or activities whose contents, regardless of their form, violate the laws of Kenyan national law, regulations or principles, values, rules and procedures of Malimali or which relate to illegal activities. In this context, we highlight illegal hate speech, terrorist, discriminatory speech, the sharing of pornographic or private images, the violation of fundamental rights, online stalking, violation of the protection of minors, data violation and privacy, among others.
If, in the course of using the Malimali Store Website, the User provides any content considered illicit or illegal or violates any legal provisions or the provisions of these Terms and Conditions, Malimali Store reserves the right to block or delete such content, without prejudice to the remedy to the competent authorities, under the legally stipulated terms.

a) Blocking illicit or illegal content means that any and all content provided will be immediately blocked, no longer visible to the User, whether images, messages, texts, videos, audio or others;
b) The temporary suspension of the Malimali Store Account means that the User will no longer be able to log into their account to place orders, which may occur for a certain period, depending on the severity of the infraction;
c) The definitive deletion of the Malimali Store Account means that the User will no longer be able to log into their account permanently. The deletion of the Malimali Store Account is definitive and irreversible.
2.2. Measures against Abusive Action
Abusive action on the part of the User is considered to be cases of provision of illicit content, offenses by Users against Malimali Sellers or against Malimali Store; fraudulent behavior in paying for online purchases, illicit enrichment, through taking advantage of a manifest error in pricing products in relation to prices charged in the market, as well as frequently submitting manifestly unfounded complaints.
Malimali reserves the right to temporarily suspend, for a reasonable period and after issuing prior notification, the use of and access to the Malimali Store Account of any and all Users who engage in Abusive Behavior. Before taking the suspension decision, Malimali will make a proportional assessment, in a timely, diligent and objective manner, based on all the facts and circumstances relevant to the decision-making.
Thus, for example, if a User repeatedly uses their Malimali Online Account to address a Seller or Customer Support, in an offensive way, affecting the honor and dignity of that person, this practice will be considered abusive and Malimali will temporarily suspend the access of the User to the Malimali Website.
2.3 Complaints management system
If the User does not agree with the decisions taken by Malimali, based on violation of these Terms and Conditions or Abusive Action, they can access, for a period of six months, Customer Support, in which they can submit their complaint , electronically and free of charge.
Whenever the User’s complaints contain sufficient grounds for Malima;i to consider that its decision is unfounded or that the contents provided by the User are not illegal or incompatible with these Terms and Conditions, or the complaints contain information that indicates that the User’s behavior does not justify the measure taken, Malimali revokes its decision.
3. Intellectual property
All content and information contained on the Malimali Website and are the property of Malimali Store or have been licensed to it and therefore the use, reproduction, copying and dissemination by other means of logos, texts, images and videos, or intellectual property, contained that is subject to your prior authorization from Malimali Store in this regard.
The Customer must comply with the contractual and legal conditions applicable to products sold on the Malimali Store Website, particularly with regard to the use of intellectual rights, copyright and related rights, personal usage rights that regulate copies, reproduction, rentals, etc. Malimali Store cannot be held responsible for any misuse that may be made of these Products.

MalimaliStore takes into account information relating to the essential characteristics of products through technical descriptions shared by its suppliers or third parties, photographs and videos illustrating the products sold, in strict compliance with the best market standards, transmitting them clearly to you customers on the page of each product and/or service.
4.2 Price Information
Malimali Store clearly makes available on its website the total price of each good or service, including fees and taxes, additional transport charges, postal or delivery costs or any other charges that may apply.
Malimali cannot be held responsible in the event of the occurrence of a computer, manual, technical error, or of any other origin, which causes an unforeseen substantial change in the sales price to the public appearing on the Worten Website, therefore, in cases where this is exorbitant or manifestly derisory, the purchase order will be considered invalid and canceled and the Customer will be informed accordingly.
